Concern For Chiquita’s Future

We’ve been praising Fresh Express for its food safety program and its donation to industry food safety efforts. However, we worry about the future of its parent company, Chiquita

It was just announced that Jim Gallagher, VP Global Sales, Scott Komar, VP Global Innovation (former VP Operations) and Sarah Stone, National Director for the entire Wal-Mart business for Chiquita/Fresh Express, all resigned.

In addition, in the last four months, two other top Chiquita Fresh North America executives — Tip Murphy, VP Sales, and Jeff Filliater, Senior VP for the entire Chiquita North America business — have either left the company (Tip) or been moved to a new position (Jeff, to VP global banana innovation).

Also, the top three Fresh Express people have left the company. We don’t know the exact reason all the Chiquita folks left, but the Fresh Express people were superstars and left of their own volition after the buyout of Fresh Express by Chiquita.

Chiquita came out of bankruptcy and is run by an ex-Procter & Gamble executive, Fernando Aguirre, Chairman, President and Chief Executive Officer of Chiquita. Tanios Viviani is the president of Fresh Express and he is another ex-P&G executive.

P&G has an excellent reputation for executive training, but so does General Electric, and recently the CEOs at both Home Depot and Albertsons, each trained at GE, had to resign after their operating success didn’t match up to their billing.

The departure of all these top people isn’t exactly a vote of confidence in top management.




USDA’s Draft Farm Bill
Targets Specialty Crops

For weeks the buzz in industry circles has been that U.S. Department of Agriculture Secretary Mike Johanns was about to unveil a Farm Bill proposal that would show special attention to specialty crops, including fruits and vegetables.

The background is that although specialty crops account for nearly half the value of crops produced, almost the entire farm bill goes to so-called program crops, such as wheat, corn, soybeans and cotton.

As a result, a sort of “let’s get our share” effort has been under way, and it seems Secretary Johanns has been sympathetic to the claim.

The PMA looked it over and defined the following areas as of special interest to the produce industry:

  • providing $1 billion for research programs targeted to specialty crops. This initiative will include fundamental work in plant breeding, genetics and genomics to improve crop characteristics such as product appearance, environmental responses and tolerances, nutrient management and pest management.
  • providing $3.2 billion to improve nutrition assistance programs by purchasing more fruits and vegetables. This funding will support efforts by schools and other participants to offer meals based on the most recent Dietary Guidelines for Americans by increasing the availability of fruits and vegetables to students participating in the National School Lunch and Breakfast Programs and to participants in other nutrition assistance programs.
  • Increasing the Market Access Program by $250 million. This initiative allows partnerships between the U.S. Department of Agriculture and nonprofit domestic agricultural trade associations to share the costs of overseas marketing and promotional activities such as consumer promotions and market research.
  • Increasing support for a number of initiatives that help to address sanitary and phytosanitary (SPS) issues and other trade restrictions that affect specialty crop and other producers.

United Fresh has worked on this issue as part of the larger Specialty Crop Farm Bill Alliance and the alliance issued a statement praising the initiative:

USDA Farm Bill Proposal Recognizes Specialty Crop Need

Washington, DC (January 31, 2007) — In a statement today, the Specialty Crop Farm Bill Alliance (SCFBA), a national coalition of more than 80 specialty crop grower organizations, stated that the comprehensive farm bill proposal released by USDA Secretary Johanns today clearly acknowledges the policy imperative to have specialty crop producers at the table during the upcoming debate over national agriculture policy. The Administration’s proposal calls for new mandatory spending of $5 billion over ten years to address issues important to specialty crop growers as part of a comprehensive plan of broad reforms to existing USDA subsidy, trade, nutrition, research, energy and conservation programs.

“Overall, specialty crops account for nearly fifty percent of domestic farm gate crop value, but receive very little consideration in the current farm bill. We applaud Secretary Johanns for his remarks today. We believe the Administration’s farm bill proposals begin to focus the appropriate attention on specialty crops, and emphasize the importance of these crops to the economic well being of U.S. agriculture,” said John Keeling, Executive Vice President & CEO, National Potato Council and Co-Chair of the Specialty Crop Farm Bill Alliance.

“The specialty crop growers across the country are appreciative of USDA for taking important first steps to address the needs of specialty crop producers as they work to improve the competitiveness of our industry,” said Mike Stuart, President of Florida Fruit and Vegetable Association and Co-Chair of the Specialty Crop Farm Bill Alliance. “USDA both understood and acknowledged the messages that specialty crop growers provided during the farm bill listening sessions about the need for adequate support for research, nutrition, promotion, conservation, market access, and pest and disease management, while at the same time not creating a system of direct payments for our industry,” Stuart commented.

“The Specialty Crop Farm Bill Alliance will work with USDA and with Congress to draft a farm bill that provides a level of resources which reflects specialty crop growers’ large contribution to the economy and addresses critical needs,” stated Tom Nassif, President of Western Growers and Co-Chair of the Specialty Crop Farm Bill Alliance. “However, the SCFBA believes strongly that this cannot include extending opportunities to program crop growers to grow non-program crops on acres that receive a continuing stream of direct payments. The SCFBA also believes that any farm bill approved by Congress must include strong funding for Specialty Crop Block Grants to states, which have proven successful in assisting specialty crop growers to improve their competitiveness in global markets,” Nassif stated.

USDA’s proposal includes significant expansion of current initiatives to assist foreign trade in specialty crops through the Technical Assistance for Specialty Crops (TASC) and the Market Access Program (MAP).To further assist in expanding trade opportunities, the agency’s proposal calls for improvements to address phytosanitary restrictions on trade, to participate in international standards setting bodies, and to provide assistance in trade disputes and legal challenges.

Importantly, the USDA proposal would take strong steps to increase the consumption of fruits and vegetables by the public and in federal feeding and school lunch programs. The National School Lunch and Breakfast Programs, the Emergency Food Assistance Program and Section 32 purchases would all be expanded and enhanced to encourage increased fruit and vegetable consumption.

The specialty crop industry appreciates the inclusion of specific provisions in the proposed energy title to encourage the development of a national agriculture energy policy that will allow evaluation and utilization of specialty crop waste and other biomass feedstock in the production of cellulosic ethanol. Finally, the USDA farm bill proposal makes a significant commitment to expanding specialty crop research. Specialty crop growers understand that research that improves production efficiency, reduces input cost, and improves product quality is the cornerstone of a competitive, successful specialty crop industry.

The Specialty Crop Farm Bill Alliance thanks Secretary Johanns for his leadership and commitment to developing an agriculture policy for the future that is equitable and sustainable. The coalition is ready to work with the USDA and the Congress to craft a farm bill that serves the needs of all agriculture producers.

The big battle in Congress is likely to be over the issue of whether program crop farmers can use land idled under those programs to grow produce. The produce industry thinks this unfair competition as these growers would have two streams of income — from the government and from the crop. Thus they would be in a position to pose unfair competition.

This whole area is obvious but also problematic. Yes, of course, if the government is going to spend countless billions on agriculture, we want our guys to get some.

Yet the bigger questions are: Why are we giving billions to program crop farmers? And if everyone just fights for his piece of the pie, who is going to fight for fiscal sanity on the farm bill?




Where’s the Fruit?

One of the reasons that we can’t seem to get consumption of produce to rise may be that consumers sometimes think they are eating produce, specifically that their children are eating produce, when they are not. That is our take from a recent study unveiled by The Strategic Alliance for Healthy Food and Activity Environments, a coalition of nutrition and physical activity advocates in California. The study finds that many products that liberally use the word fruit — or the names of fruits or photos of fruit on their packaging — in fact don’t contain any fruit. Here is the release:

Study Unveils Widespread Deceptive
Packaging in Children’s Foods

Oakland, CA — January 26, 2007…Over half of the most aggressively advertised children’s foods that prominently feature fruit on their packaging contain no fruit at all, according to a study released today by the Strategic Alliance for Healthy Food and Activity Environments. The study, Where’s the Fruit?, reveals that 51 percent of these products do not contain fruit, and another 16 percent contain only minimal amounts of fruit — despite prominent fruit promotions on the packaging.

“Parents drawn to products that seem healthier for their children based on references to fruit on the packaging are being deceived,” explains Leslie Mikkelsen, a registered dietician with the Strategic Alliance and lead author of the study. “Food and beverage companies are some of the most sophisticated communicators in the world and are clearly capable of accurately reflecting what is in their products if they wanted to.”

Where’s the Fruit? identifies the most heavily advertised children’s food products that include words and images of fruit and/or fruit ingredients on the packaging. A total of 37 products were included in the final study, and their ingredient lists were analyzed to determine the presence of fruit ingredients.

Nineteen (51 percent) of the products contained no fruit ingredients at all despite the images of fruits and use of words such as “fruity,” “fruit flavors” and “berry” on the packaging.

“One of the biggest surprises was Yoplait’s Strawberry Splash Go-Gurt Yogurt, which does not contain any actual fruit,” said Mikkelsen. “Yogurt is regarded by most people as being healthy, and one would naturally expect Strawberry Splash-flavored yogurt to contain strawberries, particularly when it is a food product advertised directly to children.”

Berry Berry Kix is another product that, despite fruit images and reference to “natural fruit flavors,” contains no fruit.

“My kids love fruit,” says Luz Maria Rodriguez, a parent in Sacramento. “It’s pretty hard to explain to an excited five-year-old in a supermarket why they can’t have the package with the strawberry on it when I’ve been encouraging them to eat strawberries at home.”

Only 27 percent of the products examined contained fruit (in the form of fruit puree or fruit from concentrate). Six percent were 100 percent fruit juice; however fruit juice does not contain the equivalent fiber, vitamins and minerals of whole fruit.

“The nation is facing a staggering epidemic of chronic diseases that result from poor eating and physical inactivity,” cautions Dr. Andria Ruth, a pediatrician for the Diabetes Resource Center of Santa Barbara. “Children are particularly affected and these food companies are making parents’ jobs even harder by using misleading packaging to lead them to think that they are making a healthy choice when they are not."

To support healthy eating habits, the Strategic Alliance is calling on food manufacturers to stop marketing children’s food products as something that they are not and to begin providing more nutritious food options. The Strategic Alliance has prepared “Setting the Bar: Actions to Improve Food and Beverage Offerings” to guide food companies in their marketing ethics. The Strategic Alliance insists that at a minimum, if companies put fruit on the label, there should be fruit in the product.

The Strategic Alliance for Healthy Food and Activity Environments is a coalition of California’s leading public health and health care, parks and recreation, transportation and nutrition organizations committed to promoting environmental and policy changes to support healthy eating and physical activity. Current Steering Committee members are: California Adolescent Nutrition and Fitness Program (CANFit), California Center for Public Health Advocacy, California Food Policy Advocates, California Pan-Ethnic Health Network, California Parks and Recreation Society, California Project LEAN, California WIC Association, Child Care Food Program Roundtable, Latino Health Access, Prevention Institute, Samuels & Associates and YMCA of the East Bay.

The Pundit is not a big fan of the organization. It proclaims its purpose to be “…reframing the debate on nutrition and physical activity away from a focus on individual choice and lifestyle towards one of environment and corporate and government responsibility.” And the Pundit believes we need more individual responsibility, not less.

Still, on this issue, these folks are in the right — precisely because if people are to exercise personal responsibility, they can’t be defrauded. It is a reasonable consumer expectation that a product named Yoplait’s Strawberry Splash Go-Gurt Yogurthas strawberries in it.

This is a place where industry-government relations efforts can be productively employed. There are many laws that prevent people from selling products that might be confusing to consumers. Wolfgang Puck got into trouble trying to sell frozen versions of his trademark pizzas. Why? Because it is illegal to call a packaged good a pizza if it doesn’t contain cheese!

The Pundit thinks we should look at a “truth in packaging” law that prevents this kind of consumer deception.

As we prepare to leave for Berlin, the European names bring a nostalgic feeling as the Pundit and his family were substantial exporters to Europe. The Georges Helfer name especially rings a bell. By the time the Pundit got involved, they worked exclusively with Seald Sweet on Florida citrus but we sold Helfer other items, including one disastrous season when all the avocados cut black.

Perhaps in Berlin the Pundit will get reacquainted with some of the people we once traded with in Europe.




Pundit’s Mailbag — Traceability

We have been running a great deal on the issue of traceback including recent Guest Pundits here and here by Gary Fleming, Vice President, Industry Technology and Standards, Produce Marketing Association.

One of the problems with the draft Good Agricultural Practices document for spinach, lettuce and other leafy greens is that, although it requires people to retain a lot of documents, it doesn’t specify their retention in a form suitable for quick traceback.

Obviously one of our missions is to avoid future outbreaks. But a second, very important mission is to make sure that if we have another outbreak, we can minimize recalls and injuries to consumers. The way to do that is with automated systems available 24/7/365.

You can’t have a delay because a farmer is asleep or on vacation.

Usually we hesitate to run letters that promote one particular product, but this gentleman claims to have a solution. Certainly it is worth exploring:

Here at www.ScoringAg.com most of your wishes and comments are running on the servers where the ScoringAg traceback database is held. You and others are right about the problems of produce movement and who has done what at what time where.

Yes, most buyers and brokers refuse to keep uniform records unless they are forced to as per Tim York’s desire. It is all a secret and it is not the grower’s, packer’s, shipper’s, broker’s or buyer’s problem if the consumers get sick (some have this thinking).

To have an outbreak, something has to happen at a location — at a field or on a reefer that was used to transport a food product to the next food handler and processor on its way to the consumer. This is where the ScoringAg’s technology called Site-Specific Recordkeeping™ takes over with our PIDC code at every food handler’s location.

So if Wal-Mart wants to move food around at the expense of other resellers, then the food records need to be uniform no matter what country or farm group. Yes, recalls need to be more specific as the industry doesn’t need whole sectors of a product removed.

What the industry needs is our SSI-EID traceback code, costing $0.0025 per final retail package, which can provide a traceback within seconds or at the speed of Google — enabling every food handler to identify the chain of custody and source verification in real time with local records of production data.

The FDA has identified many possible factors that contribute to the contamination of fresh produce, but records and actions to know the chain of custody are slow (weeks) at best and not uniform. These factors include the exposure of produce to poor-quality water, manure used for fertilizer, workers with poor hygiene, buffer zones, and animals, both domesticated and wild, on the farm, or a problem of transporters, processor and handlers at their PIDC locations.

So the question is: Why does it take so long to do a traceback when FDA requires a full traceback in 24 hours 24/7 to the source? Why does it take so long to do a traceback when businesses were required to have this capability on specific dates as mandated by the FDA Bioterrorism law? Was it because all the companies thought they could build a computer traceback system with commingling algorithms like ScoringAg, or do they just not care?

This type of program may be a solution, but its proprietary nature makes it seem unlikely that it would be the solution. This is one reason those companies with highly aligned supply chains, as we are exploring in our Foodservice Pundit series, first with Del Taco’s Janet Erickson and Notre Dame’s Dan Crimmins, then with Michael Spinazzola of Diversified Restaurant Systems, followed by Maurice Totty of Foodbuy, have a simpler situation to confront.

If the industry is going to move in the direction of highly aligned supply chains, then, of course, every supply chain can implement the proprietary programs and procedures required.

If the goal, though, is to allow all trade buyers to purchase anywhere with safety and allow vendors to recall produce wherever it may be, then we need to go in the direction that Gary Fleming at PMA was suggesting in his articles: industry standard solutions, such as GTIN, RSS, RFID, etc.

Buyer-led Food Safety Initiative
Recap XXXVII

There is an ad hoc group that started it all. The National Restaurant Association has its group working on a program and the Food Marketing Institute held a conference. All these buyer-led initiatives can get confusing, so to assist the trade in keeping track of them all, we are publishing this recap of coverage all in one place.

As new developments occur, we will continue to update this recap to help keep the trade organized on this important subject.

On September 25, 2006, in the midst of the spinach crisis, we published The Role of Retailers And The Future Of Food Safety, which pointed out that it is the “representations and warranties” that buyers demand that define the food safety programs we get:

“…in the end, the strength of our food safety systems is at least as dependent on what retailers demand as they are on what the government does for the simple reason that what retailers pay for is what they are going to get.”

Then in the issue of the Pundit’s sister publication, PRODUCE BUSINESS, which was unveiled at the PMA Convention in San Diego on October 21, 2006, we published Food Safety Is A Retail Issue, which pointed out:

“…what holds suppliers back is not that they need an FDA regulation — it is that they need to see a willingness on the part of buyers to pay more to obtain a higher level of food safety and security. So far that is missing.”

The Buyer-led Initiative for Food Safety was then announced. In time it came to be signed on to by nine important buying organizations:

Here at the Pundit, we applauded the buyer-led effort, but on October 30, 2006, ran a piece entitled Buyer-Led Food Safety Effort Leaves Open Question Of Buyer Commitment, in which we pointed out:

“What would be helpful from these buyers is…a reassurance to the grower/shipper/packer/processor community that investments in food safety will be protected.”

As Gene Harris of Denny’s added his endorsement to the Buyer-led Initiative for Food Safety, we published Pundit’s Mailbag — Denny’s Weighs In On Food Safety Efforton November 1, 2006, and we pointed out that the Western Growers Association was now looking for mandatory standards:

“Buyers can impose standards on their suppliers, but it seems as if the big grower members of WGA are more inclined to go with a mandatory program. Perhaps because this is more easily “saleable” to consumers, perhaps because the growers have no confidence that buyers will ever agree to a uniform standard on food safety and, perhaps, because growers know that buyers today can have the best of intentions but situations change and buyer’s change — and if legal product is available for much less money, that will put a lot of pressure on an organization to change its standards.”

On November 2, 2006, we highlighted an Opportunity For Buyers’ Food Safety Initiative, where we wrote the following:

“Here’s the Pundit’s suggestion to the buyers: Don’t wait for the deadline to pass. Withdraw the letter to the associations, which can only lead to endless negotiations with grower/shippers and watered-down food safety standards. Instead, create a temporary ad hoc consortium to spearhead the quick development of science-based food safety standards.

In the short term, these will be enforced by buyer demand, hopefully including other buyers who will buy into the plan; in the medium run the plan will be turned over to state authorities in California and federal authorities in Washington, D.C., as the basis for new mandatory regulation.”

We pointed out that this initiative may not stay in the hands of the ad hoc group leading the Buyer-led Food Safety Initiative when, on November 7, 2006, we announced: National Restaurant Association Forms Produce Safety Working Groupand pointed out:

“What we should have learned from the FDA loss of confidence in the industry is that food safety is not something that we negotiate over. It has to be driven by the best scientific knowledge we have.”

Mark Munger of Andrew-Williamson Fresh Produce, a grower/shipper, pitched in his thoughts on the important role buyers play in the food safety arena and, on November 8, 2006, we published Pundit’s Mailbag — Insights From A Conscientious Grower, which specifically praised one foodservice customer:

I also have to commend one of our customers, who I believe demonstrates the value of collective partnerships between growers and customers. Two years ago we began working with Darden Restaurants. Darden takes food safety very seriously. They have empowered a food safety team that must approve each and every supplier. They have inspectors in the field who make weekly random inspections of growing operations, picking and packing programs. When problem issues are identified, they work closely with our food safety team to help educate our team and to ensure that collectively we fix the problem. The knowledge that an inspector can be in any field or packing shed at anytime has forced us to treat every day as an inspection day.

Additionally, Darden’s food safety team is separate from their buying team. If a farm is not up to par, they have the authority to stop all transactions until the problems are fixed. They truly put their money where their mouth is and have helped us become a markedly better company. I cannot think of a better example of the power of collective thinking between suppliers and customers. I think the industry would be well served to learn more about their programs and create similar models.

Not surprisingly, the Food Marketing Institute was not going to be content to sit this one out and, on November 10, 2006, we published FMI Steps Into The Food Safety Fray, which detailed a conference scheduled for December 5th at which FMI would host representatives from industry, associations, academia and government to advance food safety issues. Unfortunately, FMI decided to exclude the media and we pointed out:

“…if the goal is to build public confidence in the process the industry is going through, you not only open it to media, you send a velvet invitation to the big consumer media groups.

It smells of smoke-filled rooms where deals will be cut in secret. If you let in some light and air, everyone will have more confidence in the final product.”

On November 17, 2006, we featured Tale Of Two Buyers, in which we pointed out: “If the VPs are sincere about wanting the buyers to place food safety first, the VPs have the responsibility for changing the culture and the economic incentive systems.”

Despite the impressive show of buyer support, we expressed some concern: “…it is also pretty clear that the prospect of one unified food safety standard acceptable to every one of the signatories, much less to those who have declined to sign, is somewhere between nil and nothing.”

On November 28, 2006, we published Words From Buyers Who Did Not Sign The Food Safety Initiative, and in this piece we added Mark Hilton, Vice President of Produce and Floral for Harris-Teeter, based in Matthews, North Carolina, as a signatory to the letter.

We also quoted buyers who had declined to sign the letter mostly due to their objection to the public nature of the initiative. We also pointed out how vendors were thinking:

Pundit Note: Many growers and shippers are irate over the effort as they see it as an evasion of responsibility. These buying organizations get exactly what they value enough to pay for. All too often, some of the same companies who signed the letter on Monday will, on Tuesday, buy some product without the slightest knowledge of where it came from.

On November 29, 2006, we ran Another Naysayer of Buyer-led Food Safety Initiative, which gave voice to the thoughts of some non-participating buyers that only mandatory government regulation is the way to go. Also on November 29, 2006, we published Pundit’s Mailbag — Buyers Lecturing Again, in which a processor there at the beginning of the national fresh-cut industry reminded us how uninterested in food safety most retailers were at the time.

On November 30, 2006, we continued our exploration of why some buyers were declining to join the buyer-led initiative with Self-Interests Play Role In Food Safety Initiatives. Also on November 30, 2006, we received a letter from Al Zuckerman of ProMark Group, which we focused on in Pundit’s Mailbag — Pundit Logic On Food Safety Regulation.We pointed out: “In terms of the difficulties on spinach and leafy greens, the key buyers are missing from the Buyer-led Food Safety Initiative. The buyers of the produce, in this case, are the processors.”

On December 1, 2006, we published Spinach And The Consequences Of Buyers’ Action, in which buyers who hadn’t signed on to the buyer-led food safety initiative pointed out that rigorous food safety systems will restrict supply and raise prices.

As we explained: “It is unknown if those who don’t buy spinach because of high prices will buy healthy alternatives. They may buy candy bars and die of complications of obesity. It is a completely open question as to whether safer spinach won’t cost lives in the end.”

Also on December 1, 2006, we responded to industry feedback claiming that foodservice did a better job than retail when it came to food safety by beginning a series of Pundit Pulses focused on foodservice. The first two, Pundit’s Pulse Of The Industry: Del Taco’s Janet Erickson and Notre Dame’s Dan Crimmins, dealt with how smaller buyers deal with these issues.

On December 5, 2006, we continued our discussion with buyers who refused to sign the Buyer-led Food Safety Initiative by noting that some of them weren’t thrilled with the Western Growers Association proposal either. Botulism And Carrot Juice Summary LV

We’ve been asked to make available in one place our coverage of the recall by Wm. Bolthouse Farms of certain 100% carrot juice products and the broader implications of this issue for food safety. This piece is updated regularly and will be re-run to include new coverage of this outbreak and issue.

On January 9, 2007, we published Pundit’s Mailbag — Farmers Are Not The Cause Of Food Safety Problems, which contained an important letter pointing out that farmers are expected to deliver “dirty” product to processors. You can read it here.

On January 10, 2007, we ran Pundit’s Mailbag — Oversights In Food Safety, which featured an important letter from Tom Russell of Dynasty Farms/Pacific International Marketing calling for a ban on the use of cow manure in agriculture and a “Right to Irradiate” bill. You can read the piece here.

On January 11, 2007, we ran E-coli 0157:H7 Vaccine Approved For Use In Canada, which related to efforts to stop E. coli 0157:H7 before it can hit the produce fields. Read it here.

IMPLICATIONS OF THE CRISIS
In addition, the Pundit has done several smaller pieces that touched on various aspects of this crisis. October 5, 2006, we ran a piece focused on another outbreak of foodborne illness — in this case, botulism in carrot juice. The focus, however, was on the necessity to change attitudes as the produce industry becomes less a packing industry and more a processing industry. Food Safety, Good Delivery And Temperature Monitoring was published on October 10, 2006, and pointed out that old temperature recording devices have to be superseded by new temperature monitoring technology on all trucking of vulnerable products. Catch the piece here.
